Who Can File a Wrongful Death Case in Texas
In Texas, specific criteria govern eligibility for filing a wrongful death claim. If you have any uncertainties about whether you qualify to file on behalf of a loved one, don't hesitate to reach out to Leah Wise Law Firm for a free consultation and guidance.
Under Texas law, the following parties can file a wrongful death claim:
- Spouse of the deceased
- Children of the deceased, including legally adopted children
- Parents of the deceased, including adoptive parents
If none of the above parties initiate a wrongful death claim within three months of the death, an executor of the estate may be permitted to file a claim.
Families can collectively file as a group, or an individual family member may file on their behalf. Notably, siblings and grandparents of the deceased are ineligible to file a claim in Texas.
